Judge Blocks NYS Credit Card Surcharge Law
A New York State law banning merchants from imposing surcharges on customers who pay by credit card is unconstitutional, U.S. Judge Jed Rakoff ruled Thursday, saying that the law violates merchants’ freedom of speech since it prohibits them from telling customers about the extra fees. He granted a preliminary injunction against the law but denied a motion to dismiss the case.
