Families of 2 Killed in Train-Car Collision File Lawsuits
The families of two New York men killed last year when a Metro-North train struck an SUV have filed negligence lawsuits against the railroad and its engineer.
The Journal News says lawyers for Joseph Nadol of Ossining and Robert Dirks of Chappaqua are seeking an unspecified amount in damages.
Westchester County and Mount Pleasant are also named as defendants. The lawsuit doesn’t name Ellen Brody, the 49-year-old woman who was killed when the train struck her SUV at a grade crossing in Valhalla. Five train passengers also were killed.
The lawsuits say a poorly designed crossing and an engineer too slow to apply the brakes were to blame for the Feb. 3, 2015 deaths.
Metro-North declined to comment. Mount Pleasant’s supervisor says he’s hopeful the case will be resolved in the town’s favor.
