Judge Dismisses Teachers Union Challenge to NY Tax Cap

ALBANY (AP) —

A judge has once again dismissed a challenge to New York’s property tax cap from the state’s largest teachers union, which wants to raise taxes to fund an ever growing public school system.

In a decision signed last week, state Supreme Court Justice Patrick McGrath said the New York State United Teachers had failed to show the tax cap was unconstitutional.

The 2011 tax cap generally restricts districts from increasing tax levies by more than 2 percent without the approval of 60 percent of voters. Lawmakers amended the law last year to provide taxpayer rebates in districts that stay below the tax cap.
